What are the Legal Requirements for the Sale of Skincare Products?

Where are the Legal Requirements Set Out?

The rules and regulations surrounding the manufacture and sale of cosmetic products are set out in the EU Cosmetic Regulation. This regulation aims to ensure your products are safe for use and fit for purpose.

It is important to note that there are specific requirements for EU distribution and UK distribution. You should refer to both to ensure your product remains compliant.

Requirements of the UK Cosmetic Regulation

A cosmetic brand should ensure that their product uses only safe ingredients by conducting appropriate tests and keeping up to date with safety alerts and product recalls. Two of the main requirements include:

Having a Responsible Person - Each cosmetic product listed for sale in the UK should have a ‘Responsible Person’ dedicated to ensuring the correct safety measures are followed, and legal obligations are met.

Keeping a Product Information File (PIF) - A file kept by the ‘Responsible Person’ that must be at the disposal of authorities in case of an inspection. This must include a product description, product safety report, GMP certificate, and evidence of the cosmetic product’s effects.

What are the Regulations Surrounding Animal Testing?

Labelling Requirements for Your Cosmetic Product

Did you know that labelling is a critical aspect of the UK Cosmetics Regulation? This regulation requires a brand’s cosmetic labels to be clear and to include things such as:

  • Instructions for the safe use of a product
  • A correct list of ingredients
  • Product name(s)
  • Manufacturer information
  • Potential risks
  • Precautions consumers should take, e.g. allergies

Relevant Notification and Record Keeping

It is required that all cosmetic products intended for sale in the UK market are notified to the Cosmetic Product Notification Portal (CPNP) before they can be listed in the market. This includes disclosing detailed information, such as ingredient composition and the product’s intended use.

It is also ideal to keep a record of any measures taken to ensure cosmetic product compliance in regard to the UK Cosmetic Regulation. This should include anything from product testing to labelling and notification updates. This is useful to keep in preparation for an inspection or investigation.
